A Consumer Cop On the Financial Beat

You work hard for your money. You should be able to save, invest and manage your money without fear of being trapped, tricked or ripped off by the institutions you are trusting with your financial future. 

That’s why we need strong consumer protections on Wall Street. And from the 2008 economic collapse, we know how big of an impact those institutions can have on our economy when they play fast and loose with our money. It made it clear: Americans need a watchdog agency on Wall Street, devoted to creating and enforcing fair, clear and transparent rules to protect consumers. 

So in 2010, we helped create the Consumer Financial Protection Bureau (CFPB) to be our consumer cop on the financial beat.

The CFPB Gets the Job Done

Despite the fact that the CFPB is not widely known, they’ve been hugely successful at working for consumers, returning nearly $12 billion to more than 29 million people who were ripped off by companies that broke the law … in just six years. 

The CFPB holds big banks, debt collectors and lenders accountable. Here are a few examples of some of the cases the CFPB has taken on to protect consumers:


When American Honda Finance used discriminatory pricing to rip off African-American, Hispanic and Asia/Pacific Island borrowers who paid too much for car loans, the CFPB returned $24 million to these consumers.


The Department of Justice and 47 states joined the CFPB in a $216 million action against JP Morgan Chase Bank for illegal debt collection practices affecting over half a million Americans.


When it was discovered that Wells Fargo employees were opening unauthorized debit and credit accounts using their customer's information, the CFPB fined Wells Fargo $100 million for fraud.


The CFPB fined Equifax and TransUnion — two of the three largest credit reporting agencies — $5 million for selling inflated credit scores to consumers that were different from ones actually used by lenders and returned $17 million to those harmed by the deception.

In addition, the Consumer Bureau has helped level the financial playing field, educating veterans, senior citizens, new homeowners, college students and low-income consumers on how to keep their finances secure.

The Consumer Bureau's success should be earning it applause in Washington. Yet instead of cheering on the Consumer Bureau, the Trump administration and some members of Congress are pushing to weaken or even get rid of it. 

Tell Your Senators: Stand Up For Consumers

We can keep our consumer cop on the financial beat — but only if we can convince enough senators to stand up and be counted as Consumer Champions, and stop any bad bills that try to roll back or eliminate consumer protections.

Even with the Consumer Bureau on the job, many Americans are still at risk of reckless financial practices that threaten their homes, their retirement savings and their overall well-being. That’s why we don’t simply need the CFPB to exist: We need to make it even better, by strengthening commonsense consumer protections. 

In the wake of the Great Recession, we helped spearhead the creation of the Consumer Bureau. Now, we need your help to stand up for consumer protection once again, and defend the CFPB from those who would weaken or eliminate it.

CFPB Slams Two Credit Bureaus For Deceptive Marketing, Expect Experian Next | Ed Mierzwinski

This week, the Consumer Financial Protection Bureau nailed two "big 3" credit bureaus --Trans Union and Equifax -- for deceptive marketing of their over-priced, under-performing credit monitoring subscription products.  Combined fines and consumer restitution total $23 million. I predict that the CFPB will also bring a case against the remaining bureau, Experian, and that it will pay much more, because Experian really has led the way in aggressively marketing these tawdry products. They don't prevent identity theft, nor do they always accurately disclose your credit score, at fees of up to $16.95/month or more. Yikes!

OUR TAKE ON THE LATEST ATTACK ON THE CONSUMER FINANCIAL PROTECTION BUREAU | Michael Landis

Though the Consumer Financial Protection Bureau finds itself under constant attack. The most recent is from the U.S. Court of Appeals for the D.C. Circuit. U.S. PIRG Education Fund—along with nine other consumer and civil rights organizations—filed an amicus brief in support of the CFPB’s request for a rehearing before the entire D.C. Circuit. The Department of Justice also filed a brief in support of the CFPB’s request. It is important that the October ruling is corrected so that the CFPB remains a strong and independent agency that looks out for consumers.

Big Banks Make Billions on Overdraft Fees

An analysis of new government data by U.S. PIRG Education Fund found that big banks made $8.4 Billion in overdraft fee income in the first three quarters of 2016, up nearly 4% from the same period in 2015. Since the beginning of 2015, all banks greater than $1 Billion in assets have been required to report fee data quarterly and are included in the study.

Big Banks, Big Overdraft Fees

Overdraft fees are a major source of consumer pain, since they are borne disproportionately by Americans with few financial resources. Through the first three quarters of 2016, 626 large banks reported collecting $8.4 billion in revenue from overdraft and NSF fees, an increase of 3.6 percent over the same period in 2015. American consumers should look to the Consumer Financial Protection Bureau (CFPB), which has already enforced overdraft regulations and returned millions of dollars to consumers, to take new action to prevent unfair overdraft fees.

Overdrafts continue to hit students hard on campus

Today, the Consumer Financial Protection Bureau (CFPB) released a report shining a spotlight on contracts between banks and colleges to promote debit cards on campus.  Students continue to get hit hard with overdraft fees attached to their campus bank accounts. According to the report, nearly one in ten consumers in the population with student accounts incurred 10 or more  overdrafts per year, paying, on average, $196 in overdraft fees alone. Below is a detailed analysis by US. PIRG's Chris Lindstrom, who championed the protections that the CFPB is reporting on. This report is one more example of why we need a strong CFPB.

The U.S. Federal Trade Commission (FTC) today released a major report on consumer privacy. From FTC -- "In the report, “Protecting Consumer Privacy in an Era of Rapid Change: A Proposed Framework for Businesses and Policymakers,” the FTC also recommends that Congress consider enacting general privacy legislation, data security and breach notification legislation, and data broker legislation."

Investor rights on chopping block in U.S. Senate (updated) | Ed Mierzwinski

(See updates (click Keep Reading): Today, the U.S. Senate will consider the House-passed "JOBS" Act, which weakens investor protections -- many passed after the Internet bubble burst and Enron's follow-on bankruptcy destroyed jobs and retirement savings. Its supporters claim the bill to make it easier for small companies to navigate SEC rules and  thereby promote small company growth (which theoretically creates, you guessed it, jobs), has already been thoroughly vetted. Yet, the bill is opposed by some of the Senate's most thoughtful investor champions and opposed by U.S. PIRG and numerous consumer and investor organizations. We support a substitute to be offered by Senators Jack Reed (RI), Mary Landrieu (LA) and Carl Levin (MI) because it protects investors. But if the substitute fails to get 60 votes, the JOBS Act will be non-amendable under an ill-advised special fast-track system set up to speed it through.

Senate Wants to Pass Dangerous Just Open Bucket Shops Act (so-called Jobs Act) | Ed Mierzwinski

You may not remember any pre-2008 scandals -- dot.com bubble?; Enron scandal? --  since they are so yesterday's news. Don't worry. The House and Senate don't remember, either. If the Senate has its way with quick passage of the misnamed already-House-passed Jobs Act, -- better named by the New York Times columnist Gail Collins as the "Just Open Bucket Shops Act" -- conflicted analysts will make stuff up again, government watchdogs like the SEC and PCAOB will be chained, and small and novice investors will be looking at "crowd-funded websites" from good guys and bad guys, too, including often-fraudulent Chinese IPOs. Things are so bad that the Senate's leading investor champions aren't even sure they can get enough votes to modify the proposal -- let alone block it -- even with a compromise alternative (letter from PIRG-backed AFR/CFA). Only in Washington.

In times of financial calamity, fraudsters come out to take your last dollar. This afternoon U.S. Attorney General Eric Holder will host a consumer financial fraud summit (agenda) at Georgetown Law School near Union Station bringing together enforcers from the DOJ, FTC, state agencies and consumer groups. I'll be on a panel discussing business opportunity frauds. Other panels will be on elder fraud and tax scams. The event is free and open to the public and will be webcast.
